Welcome to PlantWise, an application developed by Burak Öztopuz. By accessing or using our application, you agree to comply with and be bound by these Terms of Use. Please read these terms carefully before using PlantWise.

1. Acceptance of Terms

By using PlantWise, you confirm that you accept these Terms of Use and that you agree to comply with them. If you do not agree to these terms, you must not use the application.

2. User Obligations

You agree to:

• Use PlantWise only for lawful purposes and in accordance with these Terms.

• Provide accurate, current, and complete information during registration and maintain the accuracy of such information.

• Keep your account password confidential and take responsibility for all activities that occur under your account.

• Notify us immediately of any unauthorized use of your account or any other breach of security.

3. Acceptable Use

You must not:

• Use the application in any way that breaches any applicable local, national, or international law or regulation.

• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the application, or which may harm PlantWise or users of the application.

• Transmit or procure the sending of any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.

4. User-Generated Content

Users may submit content to PlantWise. By submitting content, you grant us a non-exclusive, worldwide, royalty-free, perpetual, and fully sublicensable right to use, reproduce, modify, publish, and distribute such content in any media.

Content Guidelines

• All submitted content must comply with applicable laws and regulations.

• You must not submit content that is defamatory, obscene, offensive, or infringing on any third party's rights.

5. Intellectual Property

All content, features, and functionality on PlantWise, including but not limited to text, graphics, logos, and software, are the exclusive property of Burak Öztopuz and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6. AI-Generated Content

PlantWise may utilize AI technologies to provide content and features. You acknowledge that:

• The AI-generated content is for informational purposes only and should not be relied upon as professional advice.

• We do not warrant the accuracy or completeness of AI-generated content and disclaim all liability for any reliance on such content.

7. Subscription Plans

PlantWise offers a freemium model with optional in-app purchases and subscription plans.

Billing

• Subscriptions are billed on a recurring basis, and you will be charged at the beginning of each subscription period.

• You authorize us to charge your chosen payment method for the subscription fees.

Free Trial

• A free 7-day trial is available for the weekly subscription option. You must cancel the trial before it ends to avoid being charged.

Cancellation

• You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period.

8. Disclaimers

PlantWise is provided on an "as-is" basis and without warranties of any kind, either express or implied. We do not warrant that the application will be uninterrupted or error-free, and we are not responsible for any interruptions or errors.

9. Limitations of Liability

To the fullest extent permitted by applicable law, Burak Öztopuz shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of PlantWise, including but not limited to loss of profits, data, or use.

10. Termination

We may terminate or suspend your access to PlantWise immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Terms of Use.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Burak Öztopuz operates, without regard to its conflict of law provisions.

12. Changes to These Terms

We reserve the right to modify these Terms of Use at any time. We will notify you of any changes by posting the new Terms on this page. You are advised to review these Terms periodically for any changes.
